Anayasa Mahkemesi 1999 senesinde Almanyaya gelen ve 5 yaşında bir alman kızı olan babanın yurtdışı edilmesini durdurdu. Mahkemeler babanın aile bağını yetirince dikkate almadıklarını açıklayan bu karar, dosyayı Regensburg idare mahkemesine tekrardan incelenmesi için gönderdi.Iki yıl yasal evliliği sürmeden önce alman eşinden boşanan ve evlilik süresinde bir çocuk sahibi olan babaya ikamet hakkı (Aufenthaltserlaubnis) verilmemişti. Kızın velayeti anneye verilmişti.Baba kızından ayrı bir şehirde yaşamasına rağmen her iki haftada kendisiyle görüşüyordu. Aynı zamanda görüşmediği zaman kızıyla telefonlaşıyordu.Yabancılar dairesi ve Baverya mahkemeleri baba ve çocuğun arasında yeterli bir aile bağı olmadığını öne sürerek babayı yurtdışı etmeye karar vermişdiler.Alman Anaysasının 6.ncı maddesine göre devlet aileyi korumak zorundadır. Bir yabancı uyruklu kişi oturum müsadesine başvurduğu takdirde o kişinin aile bağları yabancılar daireleri ve mahkemeler tarafından dikkate alınması şarttır.</p> <p>Çocuk menfaatı<br /> Yasa değişikler sonucu 1997 senesinden sonrası alman aile hukukunda verilecek kararlarda çocuğun menfaat kararın merkezine alındı. Çocuğun kendisine ait olan anne ve babayla görüşme hakkı vardır. Anne ve babada bu hakka sahiptir aynı zamanda çocuğundan ayrı yaşıyorsa bir görüşme yükümlülüğü vardır. Ayrılıktan sonra çocuğun diğer tarafa muhtaç olduğu ve onunla görüşmesi çocuğun menfaatine yararlı olduğu kabülenmiş bir ilkedir. Genelde çocuğun gelişmesindede faydalıdır.</p> <p>Aile bağları<br /> İkamet hakkı (Aufenthaltserlaubnis) alabilmek için formalite bir bağ yeterli değilder. Önemli olan aile fertlerin arasındaki gerçek bağlardır. Yabancı anne veya baba bu hakkı gerçekleştirmek istiyorlarsa aile bağlarına göre oturum müsadesine talep ede bililer. Mahkemeler tarafından soyut ve şematik kategorilere göre aile bağları değerlendiriliyor. Anayasa mahkemesi soyut şemaları doğru bulmadı. Iki haftada bir görüşmek ve telefonlaşmak çocuk menfaatı açısından yeterli ola bilir dedi. Gündemde Alman Vatandaşlığı ve “Uyumpaketi” vardı. </p> <p>Uyum Zirvesi yoksa uyutma zirvesi mi?<br /> Vatandaşlık, almanca bilmek, uyum sağlamak, zorunlu evlilikler günde medyada yer alan konular.Hatun Sürücünün öldürülmesinden ve Berlin Rütli okulundaki olaylardan sonra Başbakan Merkel 14 Temuzda gerçekleşecek bir uyum Zirvesine davet etti. Kimlerin hangi kriterlere göre çağırıldığı açık değil. </p> <p>Tartışmaların medyada geniş bir yer alması bir tesadüf değil. 2005 de yürürlüğe geçen Göç Kanunundan sonra en geniş yasa değişikliliğinin tasarısı ortaya konuldu. Sene başında İçişler bakanlığı tarafından gündeme gelen bu tasarı medyada aynı dikkatle yer almıyor. Oysa konular birbirine çok bağlıdır. </p> <p>Yasa tasarasına göre 2005 deki yürürlüğe giren kanunlarla getirilen bazı hakların geri alınması veya zorlaştırılması planlanıyor. Gerekçe olarak Avrupa Birliğinden gelen tam 11 Yönetmeliğin iç hukuka (Alman mili hukukuna) dönüştürülmesi gerektiği öne sürülüyor. Yasa değişikliği kaçınılmaz veya Almanyanın yetki dışında kaldığı gibi gösteriliyor. Tasarıyı değerlendirdiğimizde tam tersi bir senaryo izleye biliyoruz. AB Yönetmeliliklerinde zorunlu olmayan kısıtlamalar getiriliyor. Buda tasarının asıl amaçlarını ortaya koyuyor. Göç Yasası olarak adlandırılan yasa paketi başlangıçtan beri İçişler Bakanlığı tarafından göçü engelleme yasası olarak değerlendiriliyor. </p> <p>Aile birleştirme projesi ve zorunlu evlilikler<br /> Yasal çerçevede özelikle aile birleşmesi yoluyla Almanyaya gelmeyi başaran insanlar var. Kanunen aile birleşmesini tamamen engellemek mümkün değil. Alman Anayasa Makemesi 1987 yılında zamanında Baverya ve Baden Württemberg eyaletlerindeki uygulanan bekleme sürelerini anayasaya aykırı olduğunu hüküm etti.</p> <p>Tam 20 yıl sonra aile birleşmesinde tekrardan 3 yıla kadar bir bekleme süresi getirilmesi planlanıyor. 21 yaşını doldurmadan bir eş Almanyaya gelemiyecek. Almanyaya gelmeden önce almanca bilmesi şart konulacak. Bunun zorunlu evlilikleri engelemek için gerekli olduğu idda ediliyor. Oysa hiç bir zorunlu evlilik böylece engellenmiyecektir. Tam tersine bağlılıklar daha büyüyecektir. Kadınlar yöreye ve usullere göre en azından eşinin akrabalarına 3 yıl hizmet verecekler. Çocuk yurtdışında doğduğu takdirde 2 ve 3 yıl babasız büyüyecek.</p> <p>Afrika kıtasından veya Türkiyeden ailesinin yanına temel haklarına dayanarak gelmek isteyen eş ise Almanyaya adım atmadan öncesi yeterli almanca öğrenecekmiş. Elbistanda, Heratda, Malide bu insanlar nerede almanca öğrensinler? Doğumdan dolayı belirli şartlarda Alman Vatandaşı olma imkanıda (ius soli) engellenmiş olacaktır (Alman Vatandaşlık Kanunun 4 maddesine bakınız). Süresiz ikamet hakkı (Niederlassungserlaubnis) daha bir yıl uygulanmasına rağmen bir saldırıya uğruyor.</p> <p>Tasarıya göre geçimini sadece sürekli ve güvenilir gelirle temin edebilen bu haktan faydalana bilecek. Aynı çatı altında yaşayan aile fertleri varsa onların geliride temin edilmesi şart olacak. Almanyanın ekonomik sıkıntılarında bireyin kendisi ve ailesi için sürekli ve güvenilir bir geliri temin etmesi oldukça zor.</p> <p>Gençlere darbe<br /> Vatandaşlık konusunda en büyük darbe gençlere yönelik sunulan kolaylıkların geri alınması olacak. Şuandaki kanuna göre 16 ve 23 yaşındaki bir genç geçimini sağlıyamıyorsa (işşizlikden veya okul eğitiminden dolayı vs.) alman vatandaşı ola biliyor.Tasarıya göre gençlerde artık geçimini sağlamak zorunda kalacaklar. Tasarının ocak ayındaki metnindeki gerekçesine baktığımız zaman çalışmak ve uyum sağlamak istemeyen gençler ödüllendirilmemesi için kanun değişikliği gerekli görülmüş. Protestolar sonrası bu gerekçe mart ayının metninden çıkarılmış ama tasarıdada bir değişlik yapılmamış. Aynı zihniyet devam etmektedir; sadece deşifre edilmesi kolay olmayacaktır. İş piyasasında ve eğitim alanlarında göçmen gençleri için büyük engeller mevcut olduğu bilinmesine rağmen sorunun kaynağı gençler gösteriliyor.</p> <p>Alman vatandaşı olmak isteyen kişi önce kendisinin ödeyeceği hazırlık kursuna gitmesi gerekecek veya Almanya hakkında yeterli bilgisi olması zorunlu olacak. Almanca bilgisi Avrupa Konseyinin ortak refersans dil standartlarına göre yeterli olması gerekecek. Eşit haklar sunulmadıkça topluma uyum gerçekleştirelemez. Eyalatlerin hesaplaması farklı olacaktır. </p> <p>Alternatif olarak bir işverenden çalışma teklifi sunulması gerek.<br /> Teklife göre derhal süresiz işe başlaya bilme imkanı sunulması ve geçiminin temin edebilinmesi gerekecek. Yabancılar daireleri çalışma müsadesini derhal vere bilecekler. Eyalete göre bu alternatifde farklı şartlar getirilebilinir. </p> <p>İstisna durumlar (Eyalettinizde uygulama farklı ola bilir) </p> <p>-Meslek eğitiminde bulunan kişiler<br /> -Çocuklu Aileler geçici olarak sosyal yardım almak zorundaysalar<br /> -Çocuğuna yanlız bakan ve bundan dolayı geçici olarak sosyal yardım alan kişi<br /> -İşgücü olmayan kişinin geçimi ve bakımı üçüncü bir kişi tarafından sürekli temin ediliyorsa<br /> -65 yaşını dolduran kişiler. Ülkesinde ailevi bağları olmayan fakat Almanyada çocukları veya torunları bulunuyorsa, geçimini ve bakımını üçüncü bir kişi tarafından sürekli temin ede biliyorsa. </p> <p>Dikkat: Geçimini istisna durumlardada temin edemiyen kişiler için 30.09.2007 tarihine kadar iş bulma imkanı verilecek. Diğer şartlarda yerine getirildiği takdirde oturum müsadesi değil ‘Duldung’lar uzatılacaktır. Bu süre içinde geçimini sosyal yardımdan bağımsız geçindirebilecek iş bulması gerekecek. Avrupa Konseyi Sözleşmesi bu konuda ne diyor? Yazı dizisi.</p> <p>Göç Yasası’nın 30. maddesi’nin birinci fıkrası bir yabancının nasıl eşiyle aile birliği kurabileceğini düzenlemiş. Buna göre:</p> <p>Bir yabancının,eşini yanına getirebilmesi için<br /> 1. Eşlerin 18 yaşını tamamlamış olması </p> <p>2. Eşin basit bir düzeyde kendisini Almanca dilinde ifade edebilmesi ve </p> <p>3. Almanyadaki eş </p> <p>a) Bir yerleşme izni (Niederlassungserlaubnis) ile ikamet ediyor ise,<br /> b) AB ülkelerinden birinde sürekli bir ikamet izni bulunuyor ise (Daueraufenthalt EG)<br /> c) Göç Yasası’nın 20 paragrafı ve 25. paragrafı’nın 1. ya da ikici fıkrasına göre bir ikamet iznine sahip ise,<br /> d) İki yıldan beri ikamet izni bulunan ve aynı yasanın 8. paragrafının 2. fıkrası gereği bir ek şart ile damgalanmamış ikamet izni bulunması ya da daha sonra verilecek olan bir yerleşim izninin herhangi bir yasal düzenleme ile imkânsız hale getirilmemiş olması,<br /> e) İkamet izni sahibi ise ve bu izini Almanya sınırları içerisinde kural olarak bir yıldan daha fazla uzayacak ise,<br /> f) ya da Göç Yasası’nın 38. Paragrafının a bendi gereğince bir ikamet izni sahibi olmak, AB üyesi ülkelerden herhangi birinde ortak yaşamı sürdürmeye haiz uzun süreli bir ikamet izni varsa, bu kişinin aile birleşimi yoluyla getirdiği eşine ikamet izni verilir, diyerek yabancıda olması gereken ikamet izini statüsünü açıklıyor.</p> <p>AİLE BİRLEŞİMİNDE ASGARİ YAŞ ŞARTI: 18 </p> <p>Göç yasasının 30. maddesi evlenecek olan yabancı çiftlerin evlendikten sonra aile birleşimine dayalı bir ikamet izni talep edebilmelerini, evlenen çiftlerin 18 yaşını tamamlama şartına bağlamış. Yasanın gerekçesinde bu düzenleme ile yaşı küçük olanların zorla büyüklerle evlendirilmesinin önüne geçilmek, ve bu şekilde evlenenlerin Almanya’ya gelmesini önlenmesinin amaçlandığı belirtilmiş. </p> <p>Burada sadece yaş sınırı dikkate alınmış. 18 yaşından önce yasal dir şekilde evlenme hakkı olması ilgilendirmiyor. </p> <p>İlk yasa tasarısında tartışılan 3 yıl bekleme süresi veya yaşsınırı’nın 21 olmasın’dan vazgeçilmiştir.</p> <p>ALMANCA BİLGİSİ<br /> En çok tartışılan ve aile birleşiminde en çok sorun yaratacak konu ise aile birleşiminde yabancı çiftlerden aranan Almanca bilgisi şartı Göç Yasası’nın 30. maddesinin 2. fıkrasında düzenlenmiş.<br /> Yabancı biri evlenerek Almanya’ya getirmek istediği eşine, Almanya’da ikamet izni yalnızca Almanya’ya gelecek olan yabancı eşin kendini ifade edebileceği basit bir Almanca bilgisine sahip olması ile mümkündür.</p> <p>Bu şart Göç Yasası’nın 28. paragrafının 2. fıkrasına göre yurt dışından evlendiği eşini getirmek için aile birleşimine başvuran Alman vatandaşından da isteniyor. </p> <p>Dil bilme koşulundan muaf olanlar ise Göç Yasası’nın 30. maddesinde belirtilmiş. </p> <p>Bunlar; yüksek nitelikli bilim adamları veya yatırımcılar (madde 19 - 21), çok az uyum ihtiyacı içerisinde olanlar ve özellikle resmi mülteci statüsü tanınmış sığınmacılar, Almanca kendini ifade şartına tabi değil.<br /> Bunun dışında hastalıkları veya özürlülükden ötürü dil öğrenemeyen veya konuşamayanlar da dil bilme şartına tabi değil.</p> <p>JAPON’A AMERİKALI’YA ANDORALI’YA DİL ŞARTI YOK </p> <p>Yasa koyucu, uzun süreden beri kendi ülkesinin vatandaşlığına bağlı olarak Almanya’da vizeye tabi olmaksızın ikamet edebilenleri belirlemiş: Kanada, Amerika Birleşik Devletleri, Honduras, Andora, San Marino, Japonya, Güney Kore, İsrail, Avustralya vatandaşlarından dil bilme koşulu talep edilmiyor. </p> <p>Kendi ülke vatandaşından beklediği dil bilme şartını yukarıdakı ülke vatandaşlarından beklemiyor. Bu tercihi hiç bir zorunluluk olmamasına rağmen yapıyor.<br /> Serbest dolaşım hakkına sahip olan AB Vatandaşından zaten yasal olarak bu şartı getiremiyor.</p> <p>Federal Hükümet’in ‘’ yeterli düzeyde dil bilme şartı’’nı talep etmesi AB Direktifin’in 7. maddesinin ikinci fıkrası ‘’ üye devletler uyum konusunu düzenleyebilirler şeklindeki hükmüne uygun sayıla bilinir. Ancak, direktif üye devletlere bu konuda bir yasal düzenleme yapmak zorundadır, demiyor, sadece bu önlemleri alabilir diyor. Buradan hareketle, uyum tedbirleri ve basit bir Almanca bilgisine karşı eşit muameleyi içermiyor, şeklinde bir yargıya varılabilir. Kaldı ki AB Direktifinde ‘’ dil kursu başarıyla bitirilmelidir’’ şeklinde bir hükümde yoktur. </p> <p>Bu açıdan AB Direktifi amaç olarak aşılmış, direktifde arzulanan amacın çok ilerisine geçilmiş ve böylelikle bu düzenleme amaç yönünden 2003/86/EG tarihli AB Direktifine aykırı hale gelmiştir. Almanya en basitinden uyum ile ilgili önlemleri alırken bunun Almanya’da olanaklarını oluşturabilirdi. Şayet Federal Hükümet, dil bilme konusunda bir önlem aldığını ve bu önleminde AB Direktifin’nde yer aldığını iddia ediyorsa, bunun uyumla ilgili önlemlerini ve alt yapısını kendi topraklarında oluşturabilirdi ve bu sürece böylelikle katılabilirdi. </p> <p>İşin anayasaya hukuku açısından düşündürücü olan tarafı ise, anayasal mahrumiyet durumunun göz önüne alınmamış olmasıdır. Bu durum haddinden fazla yasallaştırma olarak değerlendirilebilir. Bir diğer düşündürücü olan tarafı ise bir Alman’dan istenen şartların ABD, Japonya ve yukarıda sayılan ülke vatandaşlarında istenmemesinin açıkça bir ayrımcık olmasıdır. Almanlarda en az Amerikalılar kadar kolay Almanya’da aile kurma hakkına sahip olmalıdır.</p> <p>Mülteci statüsünü hak etmiş olan bir kişi kabül edildiği tarihinden 3 ay içinde aile birleşmesine başvurduğu takdirde hem dil bilme şartı hemde gelir geçim şartı aranmadan aile birleşmesini gerçekleştire bilir. </p> <p>İKAMET İZNİNİN SÜRESİ </p> <p>Göç Yasası’nın 27. maddesi’nin 4. fıkrasında düzenlenen yabancı eşin aile birleşimi nedeniyle ikamet izini talebinde bulunan eşine verilecek ikamet izinin süresi şu şekilde düzenlenmiştir. Yukarıdaki şartları taşıyan bir :‘’ikamet iznine sahip yabancının aile birleşimi yoluyla Almanya’dan ikamet izni talebinde bulunan eşine ‘’en az bir yıllık’’ ikamet izni verilir. Verilecek ikamet izni, getirecek kişinin ikamet izninin türüne, süresine bağlı olduğu gibi, ikamet izni başvurusunda bulunan kişinin pasaportunun geçerlilik süresine de bağlıdır.’’</p> <p>İKAMET İZİNİNİN UZATILMASI </p> <p>İkamet izninin uzatılmasında, ikamet izninin uzatılması genel esasları uygulanır.<br /> Göç Yasası’nda yapılan değişikliklerin yürürlüğe girmesinin ardından, ikamet izninin uzatılması sırasında basit bir Almanca bilgisinin ispatlanması da talep edilmek zorunda. Bu şart ikamet izinlerinin uzatılmasında problemlere yol açacak.<br /> Ancak, Türk vatandaşlarının AB ile Türkiye arasında bulunan ortaklık ilişkisinden ve hukukundan kaynaklanan hakları bulunmaktadır. Au Pair hariç; başka bir işte calışması yasaklanmış.<br /> 2001 senesinde bir başka ailenin yanında hafta da ortalama 15 ve 25 saat arası Au Pair olarak çalışmaya başlamıştır. Haftada 103 Avro maaş alıp kira ödemeden aynı ailenin yanında bir yıldan fazla çalışmış ve yaşamış. </p> <p>Burhan Akyüz ve Birol Öztürk 1997 ve 1999 senesinde Üniversite öğrencisi olarak İngiltereye vizeyle giriş yapmışlar. Tatil dışında verilen ikamet izninde 20 saat den fazla çalışma hakkı verilmemiş.Akyüz ve Öztürk garson olarak çalışmışlar. İkamet hakları sona erdiğinde işveren aynı işe devam etme imkanını sunmuş.</p> <p>Davacılar kendilerinin artık iş piyasasında üye olduklarını ve yasal bir statülerinine sahip olduklarını, AET/Türkiye 1/80 Ortaklık Konseyi Kararının (OKK) 6. maddesinin 1. fıkrasından faydalana bileceğini iddia etmiştir. Hangi sebebden dolayı İngiltereye giriş yaptıklarının o kadar öneminin olmadığını ve artık bir işçi statüsünde olduklarını savunmuşlardır. Çalışma müsadesinin kısıtlı olması veya iş kontraktının süreli olması bir engel teşkil etmediğinide vurgulamışlardır.</p> <p>Davada İngiliz, Alman, İtalyan ve Hollanda hükümeti AB ülkesine sadece işci olarak giriş müsadesi verilenler OKK dan faydalana bilir diye zeminsiz bir savunma yapmıştır.</p> <p>ATAD bugünkü kararını Birden (1998) ve Günaydın (1997) davalarındaki verdiği yolda sonuçlandırdı ve Türk Vatandaşlarını haklı göstermiştir. Belirlediği şartlarda Davacılar işci statüsüne sahip ola bilir diye davayı sonuçladı.</p> <p>Yasal statüde olan bir türk vatandaşı 1 yıl aynı işyerinde çalışmışsa ve bu işine devam etme kaydıyla OKK nın 6 maddesine göre AB ülkelerinde oturum hakkını kazanmış oluyor.</p> <p>Bu kararla Alman Hükümetinin 2005 senesinden sonra Üniversite Öğrencileri bu haktan mağdur bırakması durdurula bilinecektir. Hessen Yüksek Eyalet Mahkemesinin 09. Altaki Iktisadi ve Kalkınma Vakfı Hukuk uzmanı Sayın Ahmet Burak Bilginin değerlendirmelerine tamamen katılıyorum ve sizlerle paylaşmak istiyorum. Almanya açısından iki önemli noktayı eklemek ister ve hukuki mücadelinin devam etmesinin gerekdiğini vurgulamak istiyorum.</p> <p>Birincisi Turistlerin durumu ve ikincisi aile birleşiminde Almanca sınavları.</p> <p>Karar öncelikle aktif hizmet verenleri ve ticari bir girişimde olan kişileri kapsıyor.<br /> Akıllı bir hukuki destekle bu karardan çoğunluğun faydalanması mümkün olacaktır.<br /> Almanya da sportif, ticari, külterel bir hizmet sunmak zor olan bir olay değildir.</p> <p>Fakat öyle bir girişim bile gerekli değil. Turistlerin durumu.</p> <p>1973 senesindeki Almanyadaki uygulamaya bakdığımız zaman 1980 senesine kadar calışma amacı olmayan bir kişi 3 aydan fazla olmayan bir süre için Almanya’ya vizesiz giriş yapabiliyordu. Bu uygulama 1980 senesinde iptal edildi.<br /> ATAD AB Vatandaşları yönünde verdiği kararlarda, hizmet hürriyetliği pasif hizmet sektörünü kapsadığını 1989 senesinde Cowan (C-186/87) ve 1999 senesinde Calfa (C-348/96) davalarında hüküm etmiştir.Pasif hizmet özgürlüğünden yararlananlar Turistler demiştir.<br /> Turistler ekonomik bir faaliyet yürütmeli gerekiyor (alış veriş yapmak, tedavi olmak vs.) ve bu anlamda hizmet özgürlüğünden faydalana biliceklerdir. </p> <p>Soysal kararı direkt olarak Turistleri kapsamasa da Şengen Sözleşmesine bir darbe olarak değerlendire bilinir. ATAD Katma Protokolünün Şengen Sözleşmesinden üstünlüğünü savunmuştur ve AB Ülkelerine siz tek taraflı Türkiye ilen imzaladığınız bir Sözleşmeden vazgeçemesiniz demiştir. Siyasi baskılara rağmen hukukun üstünlüğünü savunmuştur. </p> <p>Tır şöförleri uzun süren hukuk zaferlerine ulaştılar artık bir turist veya yaşlanmış akrabasını yanına getiremiyen birisi böyle bir cesur girişimde bulunması gerek.</p> <p>Karar Almanca Sınavlarını etkiliyor mu?</p> <p>Meslektaşım Stefanie Weh yürürlükte olan ikamet kanunundaki 30 Maddesinde öngörülen Almanca Sınavlarının ve Ikamet Kanunu Yönetmeliğinin 41 Maddesini dikkate alarak uygulamanın Türk Vatandaşları açısından hukuksal bir temelinin olmadığını açıklamıştır.<br /> 30 Maddede bazı Ülkeler için sınavlar açısından istisnalar öngörülmüştür. Bu istisnalar Almanyaya vizesiz girişe bağlıdır.<br /> Mahkemeler önünde Almanca bilme şartı aranmadan Almanya’ya gelme hakkım var diye dava açılması gerek.</p> <p>ADALET DIVANI’NIN SOYSAL KARARINA ILISKIN IKV DEGERLENDIRMESI </p> <p>Avrupa Topluluklari Adalet Divani, kamuoyunda “Türk vatandaslarina yönelik vize uygulamasi davasi” olarak bilinen Soysal-Salkim-Savatli davasina iliskin kararini, bugün açiklamistir. Kararin ne getirdigini belirtmeden önce, Avrupa Adalet Divani’nin, üye devletlerden gelen siyasi baskilara ve Avrupa Komisyonu’nun Hukuk Servisi’nin bugüne kadarki görüslerinin aksi yönündeki mütalâasina ragmen, hukukun üstünlügü<br /> dogrultusunda karar vermesinin çok önemli oldugunu belirtmek gerekir. </p> <p>Kararin sonuçlarina gelince, söylemek gerekir ki, bu karar, hukuki anlamda, daha önceki kararlardan (Abatay-Sahin, Tüm ve Dari gibi) sonra yeni bir adim teskil etmektedir. Söyle ki, bu kararlarda, Adalet Divani, zaten, Katma Protokol’ün 41. maddesinin 1. fikrasi (standstill hükmü) uyarinca, üye devletler tarafindan hizmet sunmak (veya almak) veya is kurmak amaciyla AB ülkelerine giden Türk vatandaslarina uygulanan maddi ve usuli kosullarin agirlastirilamayacagini açikça ifade etmisti. Bu noktada esasinda vizenin de, hukuka uygun bir yorumla, Türk vatandaslarinin durumunu agirlastiran usûli bir önlem (yani yeni bir kisitlama) oldugu açikti. Fakat bugün açiklanan kararla, Katma Protokol’ün üye devletlerde yürürlüge girdigi tarihte olmayan vize uygulamasinin, 41/1. madde uyarinca yeni bir kisitlama ve bu itibarla da yasak oldugu açikliga kavusturulmus bulunmaktadir.<br /> O halde bu karar isiginda Türk vatandaslarinin AB ülkelerine giriste vize mecburiyetine tabi tutulmasina iliskin hukuki durum su sekilde özetlenebilir: </p> <p>Eger bir AB üyesi devlet, Katma Protokol’ün yürürlüge girdigi tarihte (ki bu tarih, söz konusu Protokol’ün yürürlüge girdigi 1 Ocak 1973 tarihinden baslamak üzere, her bir üye devlet için AB’ye üyelik tarihidir) söz konusu 41/1. madde hükmü kapsamindaki Türk vatandaslarina (hizmet sunmak veya almak veya is kurmak amaciyla AB ülkelerine giden Türk vatandaslari) vize uygulamiyor idiyse, bugün de uygulayamayacak; uyguluyor idiyse de, bunun sartlarini agirlastiramayacaktir.<br /> Ancak bu noktada bazi hususlari da hatirlatmakta fayda vardir: </p> <p>1. Öncelikle bu durum, Katma Protokol’ün 41/1. maddesinin kapsamina giren Türk vatandaslarini kapsamaktadir. Basta isadamlari olmak üzere, avukat, sporcu, doktor ve akademisyenler ile turizm, ögrenim veya tedavi amaciyla AB ülkelerine giren Türk vatandaslari, bu kapsamda degerlendirilebilir.</p> <p>2. Ikinci olarak, yine yukarida da belirtildigi gibi, burada geçmise gidilerek bakilacak tarih, her bir üye devlet için Katma Protokol’ün kendi hukuk düzeninde yürürlüge irdigi tarih, yani Birlige üyelik tarihidir. Örnegin bugün sonucu açiklanan davadaki devlet olan Almanya için bu tarih 1 Ocak 1973 iken; örnegin Ispanya için 1986 ve Romanya için 2007’dir. Bu itibarla, bir üye devlet, ancak bu tarihte vize uygulamiyor idiyse bugün uygulamasi, hukuka aykiri ve yasak olacaktir.</p> <p>Örnegin olayda Almanya için bu tarih 1973 oldugundan, Adalet Divani, geriye dönerek o tarihte yürürlükte olan Alman mevzuatina bakmis ve o tarihte 41/1. madde kapsamindaki Türk vatandaslari için vize uygulamasi olmadigindan, bugün böyle bir uygulamayi hukuka aykiri bulmustur. Ancak bir üye devlet, Birlige üye oldugu tarihte zaten Türk vatandaslarina vize uyguluyor idiyse, bugün de uygulamasi, en azindan 41/1. madde açisindan hukuka aykiri olmayacaktir. (Ancak bu noktada, her ne kadar, üye devletlerin, Birlige üye olduklarinda acquis communautaire denilen tüm topluluk müktesebatini kabul ettigi gerekçesiyle, tüm üye devletler için, Katma Protokol’ün yürürlüge girdigi tarih olan 1 Ocak 1973’in esas alinmasi gerektigi de savunulabilirse de, Adalet Divani’nin konuya iliskin yaklasimi yukaridaki gibidir.).</p> <p> 3. Son olarak da, Avrupa Birligi Hukuk sisteminin kendine özgü yapisi geregi, milli hukuklarin aksine, ATAD kararlarini cebren uygulatacak bir mekanizma mevcut degildir. Yani bu nitelikteki bir ATAD kararinin fiilen uygulamaya geçirilebilmesi için, üye devletlerin, hukukun üstünlügü ilkesine saygi çerçevesinde kararin uygulamasina yönelik önlemler almasi gerekmektedir. (Ancak ne yazik ki, bu yaklasim, bugüne kadar üye devletlerden görülmemistir.) Bu itibarla öncelikle belirtilmesi gereken husus, bu kararin, hemen yarin belli Türk vatandaslarinin AB ülkelerine vizesiz girebilmeleri sonucunu dogurmadigidir. Burada yapilmasi gereken, öncelikle diplomatik kanallar, siyasi iliskiler ve ikna çabalari yoluyla, tüm üye devletlerin, bu (ve daha önceki benzer) kararlari, davadakilerle ayni durumda bulunan tüm Türk vatandaslarina tesmil etmelerini saglamaktir. </p> <p>Ancak yine bu noktada belirtelim ki, her ne kadar bu kararin somut anlamda bir seyler getirebilmesi, dedigimiz gibi, üye devletlerin tavrina bagli ise de, artik, Katma Protokol’ün yürürlüge girdigi tarih olan 1 Ocak 1973te yürürlükte olmayan vize uygulamasinin su anda olmasi, Birligin en üst yargi mercii tarafindan açikça hukuka aykiri ilan edildiginden, üye devletlerin buna uygun adimlar atmamasi halinde, vize uygulamasindan zarar gören Türk vatandaslarinin milli mahkemeler nezdinde tazminat davalari açmalarinin da yolu, kanimizca açilmistir. </p> <p>Avrupa hukukunu yorumlamakla görevli en üst adli makam olan Adalet Divani’nin tüm üye devletleri baglayan bu karari, otomatik olarak yerlesme ve hizmet sunma serbestîsi baglaminda vize uygulamasinin kaldirilmasi sonucunu saglamasa da, Türk vatandaslarinin söz konusu haklari açisindan önemli bir avantaj dogurmaktadir. Bundan sonra bu ve benzeri kararlarin etkilerinin uygulamaya yansimasi açisindan hükümetin, ilgili kamu kurumlarinin ve sivil toplum kuruluslarinin yer alacagi bir eylem plani olusturmak yerinde olacaktir. Bu baglamda, IKV, Türkiye Odalar ve Borsalar Birligi ve bu davada Türk vatandasi davacilarin avukatligini yapan Alman Hukukçu Dr. Rolf Gutman ile Türk vatandaslarinin karsilastigi bu gibi hukuki sorunlarda isbirligini sürdürecektir. </p>
